COLORADO SUPREME COURT DETERMINES EMPLOYERS CAN TERMINATE WORKERS  FOR OFF DUTY MARIJUANA USE

Hot off the presses. The Colorado Supreme Court decided today, 06/15/2015, that employers can fire workers for off duty marijuna use.  Marijuana use, even by someone legally/medically registered, where the usage does not affect performance is not protected under the Lawful Activities Statute.  The decision can be read in full here.  https://t.co/gAvxwS9kzw

NEW COLORADO LAW REQUIRES INVESTIGATORS TO BE LICENSED & BONDED

Colorado law recently changed (June 1, 2015) and now each individual investigator must be licensed and must provide a bond of $10,000.00.  No longer is it sufficient for just the investigative agency to be licensed.  So when getting surveillance make sure that each of the individual investigators involved in following, filming, conducting social media searches, etc. is licensed.  More information regarding this new requirement can be found in the link here.  http://cdn.colorado.gov/cs/Satellite?c=Document_C&childpagename=DORA-Reg%2FDocument_C%2FCBONAddLinkView&cid=1251662330938&pagename=CBONWrapper

 

BE ON THE WATCH FOR REQUESTS TO CHANGE PROVIDERS

We’ve recently seen an uptick in claimant’s attorneys burying requests for change of providers deep into their opening letter (often on the second page), or in letters formally addressed to the Division of Workers’ Compensation but copied to the claims representative. Just a reminder to take the time to read everything you get from a claimant or his/her attorney thoroughly!
